KingCast presents: Neighbors!

Here's the Brockton Enterprise story, which does not yet reflect the comment I just posted, as screen captured, above. I trust it will appear shortly, as it does not violate any of the Terms of Service, etc. etc., just good earnest journalism.

1. Boston Globe and Fox 25 are totally incommunicado, asleep at the wheel despite being notified about this. They both had good prior coverage, I am holding the Fox 25 VHS (remember those LOL) in my hand, and it will be part of the final KingCast short film. The Globe wrote about a $175K verdict in a Worcester case (which I cannot find online) but this case was ten (10) times that, so yah I find it more newsworthy call me crazy.

2. Attorney (Superlawyer, like Jeffrey Denner from my Boston Bob days) Richard Serkey "We do not have any comment." I wasn't even going to ask him how many closings his firm has done in the area and for which bank, more on this later.

3. Attorneys Minchoff and Kusma will be interviewed this afternoon.

So here you have three sets of neighbors, one set still tight as Gorilla Glue after 37 years. Another still tight after 5 years. And one set that witnesses acts so severe as to warrant a $1.6M verdict for Civil Rights and property claims in Scott Hyman/Julie & Don Prescott v. Hemlock Association of Lakeville, MA.

They should have taken the Settlement offer, it was peanuts next to this, but their collective and individual hubris did them in, ahem. As if this is going to be overturned on Appeal, you better think again. The Judge was fair and impartial, didn't kneecap either side. I watched him carefully.

I can't wait to video Joanna Marinova's Defamation case and see what the idiots at the Boston Globe do. As for the Hemlock Defendant, those of you who didn't take the previous advice to cop a Homestead during one of the meetings you selectively notified folks about don't go trying to do it now because you really can't..... You've already got a Judgment against you so that property can be attached, kinda' piercing the corporate veil style 'cos the Association is your Alter Ego. And these homes for most of you are summer homes, Holmes so you can't cop a Homestead on it anyway, that's elementary, Watson. Wave buh'-bye to somebody's property, who will be the sacrificial lamb?

Defendant Hemlock Association's Motion for Judgment Notwithstanding the Verdict/Motion for New Trial:
Chiefly it argues that there was not enough indirect evidence to infer that the Association members committed any of the violations complained of. I did not see the entire trial but I did see at least two witnesses testify that they witnessed trespass, as shown in my videos. There are also arguments that the Defense was kneecapped by not being able to introduce evidence they claim could show that "renegade motorcycle clubs" could have burned out Mr. Hyman's Middleboro home. Defendants also claim that they should have been allowed to mention Mr. Hyman's bankruptcy filing but of course if they are permitted to broach that subject then he will be permitted to delve into the attorney fees and costs he has had to pay in the other litigation that he will allege broke his wallet and left him unable to tender an effective subsequent bid on the property. Stay tuned for the Plaintiff's Reply Memorandum.

10:30 a.m. 12 June update, Plaintiff's response:
Okay, I missed several days of trial because I was traveling. Attorney Minchoff is expected to argue on the swastika/feces/urine/picnic tables through the windows that Scott Hyman did produce testimony at trial that Bren Ladino told him "I didn't do it but I'm not saying someone else in the association didn't," and that Ronald Dufresne told him "I don't know who did it but your kind is not welcome here."

This in conjunction with the now-infamous "You wouldn't want to wind up like a buoy would you.... that's a dead fucking thing that floats in the water....."

Objection! you scream..... You can't have Scott Hyman talking about the damages to his house because there's only inferential proof that anyone tied to the Association did it. Well that's a great argument..... except it wasn't made at trial, where the Defendants had only a standing objection to Hearsay. But the Hyman & Prescott observations of the degradation of their respective properties is not Hearsay.... it's a firsthand event, so now the Motion for JNOV is basically asking His Honor to strike that which was not objected to. Once the Jury had the testimony it was not unreasonable for it to find a Causal.

So I don't like Defedant's chances on that, but perhaps the Association could sue Attorney Serkey for malpractice if this is such a key point and he missed it, and then his insurance carrier could settle it up with the Plaintiffs. That would make a nice and tidy picture..... I wouldn't know, because while I was never a "Superlawyer" I also never got sued for malpractice..... I only help people recover for malpractice claims, i.e. Derrick Gillenwater v. "Superlawyer" Jeffrey Denner hahaha.... (Harvard Citizen Media blog coverage).

But alas, I digress. Also interesting is the admission that Hemlock buddy Steven Berk likely committed the arson at Mr. Hyman's Middleboro home (p. 11) but only to get rid of some DNA evidence as opposed to because of Mr. Hyman's Jewish background. Oh, okay, that's cool then..... my bad, dude.

Lastly, there is a reference at page 12 to some allegedly threatening words that Scott Hyman said to a customer about burning houses down. The Motion reads "We [were screwed] because we were precluded inquiry into an intense dispute going on in April, 2006......"

KingCast review of the matter, including a phone call to the hosting newspaper, reveals that the story was written by a reporter no longer at the paper and that the story was written on 4 June 1995. I knew that, I could tell that because of the cars involved. Fascinating.

It's so real that it appears Casey Sherman had to de-friend me on FaceBook because people were accusing him of not being objective, even though we both clearly disagree about some things, i.e. Bruce McKay's evil nature. Again, I feel my position is valid, as buttressed by, inter alia, the disposition of SB 154 Bruce McKay Highway, see the Cool Cats series featuring Issac Hayes and Jesse Jackson on the intro :)

KingCast remembers the Quincy "Road Rage" cocaine case that major media seems to have forgotten, entirely.

As someone who has written for a large weekly and a large daily I find it absolutely fascinating how ephemeral some stories are. Take the Quincy "Road Rage" case that I choose to follow. I'm out of town and forgot to call in to the Courthouse yesterday for the (yet again) delayed final pretrial date but when I run a Google search nothing pops up.

In fact, the major press have never appeared at the recent hearings, only me.

So what makes a story front page news.... errr... "All the rage," hahahaa.... one day and a complete non-issue the next?

I don't know. You tell me. I'll tell you what I discover on Monday.

KingCast keeping tabs on Boston Herald Defamation Defense attorneys Brown, Rudnick as they keep tabs on KingCast.

Hey guys, what's so fascinating about my 650R that you downloaded a picture of me on it, or my winning in the Ohio Court of Claims on V96-61481, proving that some bad cops made my client Michael Isreal a victim of violent crime? You were reading about that a few days ago.

Or the cocaine in Jennifer Bynarowicz's car when her BF Joey Fasano had the "road rage" issue with Mr. O'Connell, on 16 June, you downloaded the police document. Pretrial 25 June, BTW.

And what's so special about me winning over Boston Powerhouse "Big Dig" Attorney Jeffrey Denner on the Free Speech issue when Harvard's Citizen Media Blog determined I was correct as Boston Bob, i.e. that Denner and Kevin Barron had convinced the Courts to issue Unconstitutional rulings against Derrick Gillenwater?

Surely you don't plan to call me as a witness in the pending Joanna Marinova v. Boston Herald and Channel 7 Defamation Action, that would probably not inure to your client's benefit. But if you want to show up on KingCast multimedia and on YouTube like the folks in the ongoing Scott Hyman v. Hemlock Association case, be my guest. I love making videos, so it could be win-win for me and a lose-lose for you. Whatever guys, suit yourselves. If I can discuss it with Governor Patrick at Juneteenth last weekend, I feel comfortable discussing it before a Jury.

KingCast observes the Scott Hyman v. Hemlock Association racist/anti-Semitic case Day3: "Here come the Police!"


Several area LE have testified and will continue to testify on behalf of the Plaintiff. They are not happy with what they observed out there at the Hemlocks. KingCast video late evening/early morning. For now, you newcomers (and old-timers) enjoy the first two KingCast short films.

The Defense is expected to argue at closing, that any pictures taken of Lot 14 were a Good Faith response to a directive made by Lakeville PD to take photographs of the issues at stake. The Plaintiff is expected to argue that the level of photography, including pictures of young children, exceeded the scope of any such implied authority. Wait for the videos of related testimony, I should have something up Wednesday.

KingCast presents: NOT TOUCH 106.1 FM Blog

This blog was started in agreement with “Brother Charles,” owner of TOUCH 106.1 FM radio, where I have co-hosted many evening drive time shows with “KingCast cases” on “Touchbeat.”

At some point Brother Charles purportedly told someone else to ask me to disavow any association, so this blog is now about my experiences and what SHOULD be covered by TOUCH 106.1 FM but which are not. I am critical of the station and of Brother Charles so this blog is covered by Fair Use.

KingCast says the Scott Hyman v. Hemlock Association racist/anti-Semitic case boils down to a question of Faith.

New KingCast short film late tonight :) LOADED.
You saw the video. Now you see some stills pending this evening's video. On being told that Bren Ladino purports to be half Jewish, Plaintiff Hyman said "Yes, I question her Faith."

Defense counsel wrote it down, everybody wrote it down because his delivery was sincere.

At break, Defendants and their counsel were busy watching KingCast, I grabbed an uber-quick, blurry image, what a hoot. Meanwhile Plaintiff's side is not worried about any of it, they are giving and getting hugs and love.

The Defense strategy thus far was chiefly to:
a) Raise a letter written at the behest of Plainitiff's bank about total loss and fire, as if he had plans to burn down his second property or someone committed arson.
b) Claim that he has honored a Germanic flag, to which he explained that it was a shared symbol by several professional motorcycle builders that "we were into choppers."
c) Beat up on the witnesses, which at once failed and curried no favor among the Jury.

Scott Hyman is a Good Guy, and the ADL should support him in this case. So he got mad once and said something that resulted in a mutual stay away order with Bren Ladino, after what he's been through, Big Whup. Look at the love in that extended almost-family group in the hugs, got that on video and you can feel it. And you also know that part of the reason Scott and Marcia broke up was because of this added stress, but you can see the love and care is still right there.

Meanwhile folks from Lakeville were busy scorching the Earth with makeshift, ersatz Swastikas on the golf course, all aimed at a certain black man named Barack Obama. Query, was this the same set of walking scum who hurt Mr. Hyman and his friends and family?


Anyway, the only people you beat up on in front of a Jury are unsympathetic people like bad cops, never a nice, intelligent attractive female teacher, wow. That's trial tactics 101, duh. Let me show you how it's done, at 3:40 in this video from the Dan Talbot Revere police murder trial series. Here we were preparing for a Jury view of the "High Crime Area" which was really Michael Isreal's mother's Civic Award-winning garden. What a crock of dookie, spread thicker than the shit stains spread on Scott Hyman's door handles. That cop, McFadden, actually provided bad testimony that helped send Allen E. Thrower to Death Row for a while..... but I couldn't bring that in. Anyway, ain't it funny how you see a hater get desperate and irrational under pressure?

Scott Hyman used to be a vibrant, upbeat kind of guy. But that all changed after folks in his racist community smashed his windows with picnic benches, smeared urine and feces throughout his home and committed other acts so incredible as to shock the human conscience. Read this post.

KingCast raw video presents Hyman v. Hemlock et al: Hate crimes, racism and anti-Semitism poison Lakeville/Long Pond Hemlock Association.




"I'm accused of being a horrible person," volunteered Long Pond/Hemlock Association Defendant Bren Ladino this morning. This relates to this Boston.com ancient coverage (where are they now?) and this one from Enterprise News (same question).

This is a case so foul that even seasoned court personnel looked on in shock and utter disbelief. The video is coming. Wait for it.
"Mr. Pedranti said 'you shouldn't stick your nose in other people's business,' and he said he had 'friends in Boston I wouldn't want to meet....' I said excuse me? Are you threatening me? He says "Did you grow up on the water?" "No" "Then you don't know what a bouy is... it's a dead fucking thing that floats in the water, and you wouldn't want to find yourself being a bouy would you."

Pedranti then walked off to Defendant Ladino's home.

Scott Hyman worked hard, bought his own little island at Lakeville Long Pond. He owned a hot dog stand years ago and XXXTreme Cycles, he crafted choppers like Orange County Choppers. He and started to rehabilitate existing structures in order to build a place where he could live in "peace and quiet," as he testified today at Brockton Superior Courthouse. Instead he was met with death threats, swastikas, picnic tables through his window, theft and an application of urine and feces smeared throughout his new home. There is an access/easement property dispute at hand, but behind, around and even perhaps in front of that matter are the alleged Civil Rights, nuisance, trespass and emotional distress claims mounted by Plaintiff Hyman, and they reflect extremely disturbing, inhumane behavior of the lowest Order.

As someone who has lived racism in housing (we were some of the first blacks in Cleveland Heights in 1970 and involved in Heights Community Congress v. Hilltop Realty, 774 F.2d 135 (6th Cir. 1985), cert. denied, 475 U.S. 1019 (1986)), and as someone who has successfully litigated Housing Discrimination (Hamm v. Gahanna) I took a keen interest in this case and plan to report on it as much as time allows. What if he were black? Same thing. It wouldn't surprise me if there were restrictive covenants to prevent "Kikes" and "Niggers" from owning that property in the first place.... It gives me the creeps, right here in good ol' "liberal" Massachusetts.

Having attended Hawken, a largely Jewish-attended prep school in Cleveland (fun visit video here) most of my friends were and still are Jewish. And while we may have disagreements over the Gaza Strip or other Mid East matters, if anyone ever harmed them based on religion or race I would have their back, totally.

I wish I had time to attend the entire trial but I have obligations to my nonprofit group, but fortunately I was able to get some of his direct testimony this morning and am working on a raw video montage. Everything in this piece will be raw, no photoshops whatsoever, as befits the occasion. Enjoy the stills, I'm working on the video now and hope to have it up before I leave for my nonprofit activity at 4p. Having hosted a Hate Crimes forum with noted Civil Rights lawyer Terry Gilbert and Ohio former AG Lee Fisher (both of whom I clerked for in law school), I am appalled. I was appalled when it happened to my brother Michael Goldstein in Nashua, NH a few years ago, and I was appalled when it happened to then-UMass Amherst student Jason Vassell, in a case in which a racist prosecutor named Elizabeth Scheibel actually went after the victim, eventually dismissing all charges against him while not even prosecuting one of his drunken white attackers, watch the video.

KingCast presents: Racist Prosecutor Elizabeth Sheibel's self-serving Jason Vassell editorial.

Here it is. I dissected it quickly and with impunity. Excerpt:
2. Given the disparities in criminal backgrounds between Mr. Vassell and his attackers, the severity of discrepancy between the charges sought against Vassell vs. Bosse and Bowes is appalling, and you got caught at it.

You have not weighed in on Lieutenant Thrasher’s racist assumptions that Jason Vassell is a drug dealer, when in fact it is much more likely that Messrs Bosse and Bowes have dealt drugs than Mr. Vassell. Have you recommended any discipline for his attitude yet, or will you ever? Go ahead, shock me. Prove me wrong and I'll buy you a beer but we won't go out and smash any windows, eh?

Look, as a former AAG you and I both know we could sit here and throw a ton of legalese back and forth but I find it more compelling to show the video and give it to you short and sweet. And here is what is the shortest and the sweetest:

I believe your actions in prosecutorial discretion constitute a disparate impact against black men. Similar thing as the ridiculous State v. Baran prosecution here, with a lying prosecutor, and Harrington v. Richter down at SCOTUS.

Even if your actions were not racist, they were ridiculous. If you take some sense of pride in that, some kind of some pyrrhic victory suit yourself my friend, but I’m not fooled.

KingCast tells Ramiro, "Eat sh*t and die dude" as Inmates secure $1.5M for urinating and defecating in cups.

Here's the case, only a little blurb in Boston.com of course. So this guy actually had the nerve to say things like "If I ran a prison they would have to sh*t in their hands," or words of similar import, etc. etc.

Dude you are acting in the manner of a Big Media pawn, put there to be nothing more than a gate keeper because of your influence. People like you encourage people to abdicate their Civil Liberties at the drop of a hat, or worse yet, not to think about them in the first place. As a former AAG who has represented and sued LE, and as a journalist who has run video at trials back in the '90's and recently here in Boston (Dan Talbot police murder trial) I implore you to THINK before you shoot your mouth off like that, bro.

People in prison don't cease to be human just because they are convicted of committing a crime. Some of them are not even guilty in the first place, what would you do if that sh*t happened to you, huh? What do you say to them, "too bad so sad hard cheese, shit in your hands, dude." Further, many of them are indeed capable of rehabilitation, which is -- the last time I checked -- part of the penal system, at least allegedly. But guess what? If you keep people in an environment that is intentionally indifferent to humane treatment you may scare a few of them straight, but you will permanently damage all of them, and encourage more of them to come out as angry, vengeful people.

Given your attitude I would imagine you probably think it's okay for the DOC, the historically racist Boston Herald (remember Boone the Coon?) and Channel 7 to fabricate lies about Darrell Jones, Joanna Marinova and State Rep. Gloria Fox. Well I call bullsh*t on that, and so too does Todd & Weld, hence the Defamation Lawsuit that I predicted on my radio show months ago. But if you want to be like Stephen Glass and Jayson Blair, be my guest, I'll just sit back and document it.

Meanwhile did you know the Commonwealth spent $57,948.07 on the Harshbargar Report (per 9 June 2010 response to my Public Information Request) only to ignore its entire essence? Do you know who Guru's (RIP) father is and how he tried for meaningful reform in the DOC? I'll school you right here, son.

NH and MA Law Enforcement do some good things and they do some bad things. Allowing Amy Bishop to get away with the murder of her brother (IMO) was a Bad Thing, but at least now they did a Good Thing and set it before a Grand Jury that returned a True Bill for Murder, here is today's Boston Globe Coverage.
Norfolk District Attorney William R. Keating, announcing the indictment during a press conference, said law enforcement authorities in Massachusetts failed decades ago.

“Jobs weren’t done, responsibilities weren’t met, justice wasn’t served,’’ Keating said.

No shit, Sherlock. Here is a little KingCast history on the matter, as well as other incredible derelictions of duy.

I doubt this one ends up like Lizzie Borden's case.

KingCast and DSCC review Kelly Ayotte's Testimony and Moments of Truth on FRM Ponzi, Franconia coverup and being a big business dupe in general.


Oh, yah, here's the Democratic Senatorial Campaign Committee (DSCC) link, and they've got some nice reading material there I'll be checking out today. They say, inter alia:
As the state’s attorney general at the time, Kelly Ayotte was responsible for going after criminals like those at Financial Resources Mortgage, a company whose executives’ alleged Ponzi scheme bilked at least 150 investors out of more than $20 million. According to a recent attorney general report, the Ponzi scheme has “had a substantial and long lasting impact on the investors who, in my cases, lost their life savings.”

The report states that, under Ayotte, the attorney general’s office repeatedly missed opportunities to uncover and stop the Ponzi scheme.

Despite the report’s findings, Kelly Ayotte refuses to release the entirety of her emails and other key documents related to the massive fraud case. On May 11, documents from Ayotte’s time in office were released to the public, yet none of them referred to FRM, instead revealing correspondence from Ayotte related to office pizza parties and other administrative functions.
