Whoa... read the Monday update, these guys lied to the Chief of Security about KingCast/Mortgage Movies so I am filing an Ethics Complaint on them with NJ Bar.

This time I will simply quote from others at Lawyers and Settlements as the staff and lawyers at Phelan Hallinan & Schmieg vacate their office and call the police on KingCast/Mortgage Movies and an alleged debtor. Too bad for them when LE arrived they actually agreed with us, and asked "What the fuck is going on here...."

I'll tell you what the fuck is going on here, is that Attorney John Narkin is getting ready to update his class action pleadings and add some things that I'm not going to get into in this space. Also it's not like they can make me go away.... I'll be at every single public hearing documenting all of this sketchy foreclosure action against a guy who has repeatedly asked to see verification of ownership and chain of title and offered payment on his "loan" which is more aptly described as an undisclosed investment contract making millions for greedy banks and their friends with every signature....... Meanwhile all I wanted to ask these knuckleheads was whether they had complied with the current New Jersey mandate to Show Cause. To me it's a logical question because as I queried in my Ethics Fraud update against NH Hillsborough Judge Diane Nicolosi and Schectman, Halperin Savage Attorney Shawn Masterson: Standing is Law School 101....Did you guys pass Civil Procedure class or not?

And who died and made Wells Fargo the Pope... they're more Perp than Pope but still getting away with it here and in the NH case.... Every time I see a law firm acting in this manner I am going to file a professional Ethics Complaint against them for conduct unbecoming.

Philadelphia, PA: Got to hand it to attorney John Narkin. He's got this foreclosure crisis thing figured out—well, near as anyone can figure it out. The 113-page class-action suit on behalf of distressed homeowners filed by Narkin's firm, BHN Law in Philly, lays out the whole sorry story in amazing detail, complete with links to video clips.

In addition to demanding that well-known culprits in the lending business pay up for the pain they caused, BHN also comes down hard on a law firm that worked with Wells Fargo, N.A., Countrywide, and others. It describes the firm in the documents filed as "a foreclosure mill" with a Gordon Gecko "greed is good" attitude.

"Obviously this is a national disgrace," says Narkin, whose firm specializes in hunting down boogie men involved in everything from securities fraud to consumer protection law.

"The tentacles of the foreclosure mess are amazing," says Narkin. "The mess created by predatory lending is one thing, but consider also what an awful investment collateralized debt lending turned out to be." (KingCast adds that there is yet more to this story but I'm not telling it right now. Just think about the duties to the Trust that are typically violated during collateralization).

Narkin's firm has devoted hundreds of hours to a class-action complaint that alleges that Countrywide, Wells Fargo and a "high-volume law firm," Phelan Hallinan & Schmieg, engaged in fraudulent schemes to collect inflated and manufactured foreclosure fees from financially troubled families in danger of losing their homes.

Okay I was just getting ready to head down to the Courthouse to check up on the status of the Robert O'Connell, Joseph Fasano, Jennifer Bynarowicz Quincy Cocaine road rage shooting in which Fasano -- with a known domestic violence past -- was reported to have cocaine on his face. There was cocaine in the Bynarowicz Jeep and she copped to it as seen by the KingCast court file investigation.

But now we apparently have much more than that going on folks, as the Boston.com screen capture shows... William S. O’Connell, who is O'Connell's uncle ~~or father~~ and former State Senator, was popped for 19 golden grams and Stat Rape with a kitlin' 14-16 years of age..... Whoa. See folks have been telling me that years ago one of the elder O'Connells' friends turned up dead off a yacht during a little cocaine party and I have told these people that I will always report what is reasonably true. At this point I cannot -- nor can anyone -- actually substantiate the yacht party cocaine but I now feel comfortable enough to mention the rumour on my page.

Note that the Patriot Ledger's excellent coverage mentions the incident and the dismissed drunken operation charges as well as his son's second-degree murder in the stabbing death of 22-year-old Julie Hamilton, who knew Matthew through her boyfriend. Matthew O’Connell is being held at Bridgewater State Hospital, a medium-security facility for inmates deemed in need of psychiatric care.

Unlike Howie Carr I'm not stupid enough to get successfully sued for Defamation, hahahaa.... I'll update this journal entry soon but here are some vintage entries for your viewing mispleasure:

On appeal, defendant argues that (1) Wells Fargo failed to establish that it is the holder of the negotiable note she gave to Argent and therefore lacks standing to pursue this foreclosure action; (2) even if Wells Fargo is the holder of the note, it failed to establish that it is a holder in due course and therefore, the trial court erred in concluding that Wells Fargo is not subject to the defenses asserted by defendant based on Argent’s alleged predatory and fraudulent acts in connection with execution of the mortgage and note; and (3) even if Wells Fargo is a holder in due course, it still would be subject to certain defenses and statutory claimdefendant asserted in her answer and counterclaim.

But when it all comes down, at least I've never been successfully and repeatedly sued for Defamation. In point of fact I've never been sued for Defamation because unlike Howie Carr I know who I am writing about. And unlike Jessica Van Sack, I know what I'm writing about. And as to the fact that you and Howie Carr are business parters with Casey Sherman, who notes that I "literally helped him write "Bad Blood: Freedom and Death in the White Mountains," (he says so at 4:40 of the bottom video) I really couldn't care less. Frankly I was shocked to discover that he runs with lowlifes like you, but hey it's all right as long as he disinfects his hand before I shake it next time I see him.

Foreward: The email to my peers under the bogus Kelly Ayotte indictment and fired Jaffrey PD (drawing disability payment) Marty Dunn criminal charges (all dismissed) when I was NAACP Legal Chair is in the comments. I've been waiting 5+ years for this moment.

So life can't be all about the new Triumph and waiting for springtime to use it to jet from media event to media event. No, indeed it isn't, so I turn my thoughts back to next week's NENPA Conference on the subject of who and what is a full-fledged journalist. John Christie and John Voket will join me. This is my first entry on the matter noting, inter alia, that you are allowed to have strongly-worded opinions and still be a journalist. Heck, folks like the Boston Herald's Michele McPhee have strong opinions so I give it right back to her. Basically she said former Boston City Councilor Chuck Turner was a "bigoted moron" and I said she and the Herald are "racist tools of oppression, and proper subjects of successful Defamation lawsuits."

I have always liked Clarence Page, way back I was working in mainstream press. In this 2005 PBS segment he says "We're all journalists, just get your facts straight or lose credibility." As we shall see in this journal entry that admonition also applies across the board, ahem.

To my mind there are two key components to that equation and they involve access to crime scene information and reporter's privilege in States that recognize shield laws.

The Police access issue I deal with on an ad hoc basis, I just carry a KingCast business card and an admittedly expired NENPA card, explaining that they don't issue them anymore because it has become too confusing to, ahem... police. Then I turn to Mortgage Specialists v. Implode Explode, as I told Nashua, NH City Attorney about the NH High Court case that awarded full privileges to online journalists:

Freedom of the press is a fundamental personal right which is not confined to newspapers and periodicals. . . . The press in its historic connotation comprehends every sort of publication which affords a vehicle of information and opinion.

See it used in context in this journal when the GOP threatened to arrest me prompting further and ongoing litigation.

Now here's where it gets really interesting:

Implode-Explode dealt with two NH entities in a State the recognizes shield laws. Massachusetts does not recognize shield laws, which is good in case like Joanna Marinova v. (Michele McPhee Protege) Jessica Van Sack, Boston Herald et al, because as my Public Information Request and cour file review shows at least one EOPSS manager believes there is a "dirty cop" violating CORI laws and helping the Herald to commit Defamation. I'm pretty sure I know who this dirtbag is, but that's not for this discussion.

But in large part, on balance, we should have shield laws but the question in the modern global era of communications is this: What happens when you have diversity of jurisdictions? The mind boggles:

1. If I live in MA and write a journal entry about someone in NH am I covered?
2. If I was standing in NH when I wrote it am I covered?
3. If I was standing in another state with privileges but still living in MA am I covered?
4. If I have a NH partner and s/he provides me information that I publish with her byline while I sit in MA am I covered?

You get the picture, and the question is going to be what law governs, probably the state where the Plaintiff resides. The court addressed related issues in Price v. Time, Inc., 416 F.3d 1327 (2005), a wild decision issued on the matter by Federal Courts after the Alabama High Court punked out and refused to answer the question as Certified to it by the Federal District Court. The Decision (on the statutory and to some extent on the general First Amendment Privilege) cuts against the principles enunciated in Implode Explode because the Court found that Time/SI were not journalists within the meaning of the Ala. Code § 12-21-142 after this and other steamy passages appeared (it wouldn't be KingCast without some sex ever now and then, natch).

At about midnight [after leaving the club] Price headed back to the hotel. He eventually met up with two women, both of whom he had earlier propositioned for sex, according to one of the women, who agreed to speak to SI about the hotel-room liaison on the condition that her name not be used. The woman, who declined comment when asked if she was paid for the evening, said that the threesome engaged "in some pretty aggressive sex." She said that at one point she and her female companion decided to add a little levity to the activity: "We started screaming 'Roll Tide!' and he was yelling [**7] back, 'It's rolling baby, it's rolling.'"

Unfortunately Reporter Yeager, much like Van Sack, ran the story about sex without talking to everyone involved and got his ass handed to him in Decisional dicta. Okay so enough of that, and all I can tell is that the case likely settled after the Court ordered that the Plaintiff had not exhausted any and all other possible avenues to determine the identity of the sources.

Update, whoa wait a minute: I just found L. Michael Higgins' excellent "Rusty Shields" law review article 37 Cumb. L. Rev. 263 that sums it up quite nicely. I've got to find the writer and forward this journal entry to him.

The more important wake-up call derived from Price is that members of the news-gathering and disseminating community who do not happen to work exclusively in the statutorily favored trinity of news services (newspapers, radio broadcasting, and television stations) still do not know with any degree of certainty whether the assurances of confidence they give to their sources will be respected by the courts should litigation or prosecution ensue.

This situation is not peculiar to Alabama or state law. Testifying before the Senate Judiciary Committee in the summer of 2005, Time Magazine's Matthew Cooper, one of the two reporters implicated in the Valerie Plame investigations, expressed his frustrations with the current state of journalistic protection:

The rules of the road as I try to do my job as a reporters [sic] are chaotic at best . . . . Right now, if I pick up the phone and call a senator or his or her staff or a civil servant and they say, "Don't quote me on this, but . . ." or "Don't identify me but . . ." I can't really know what I'm getting myself into assuming what follows is important and controversial enough to rise to the level of litigation. . . . As a working journalist, I'd like to know better what promises I can legally make and which one's I can't. n150

Well in point of fact many of us would like to know the same thing... and that is why we are about to engage in this forum.

Judge Cratsley to Howie Carr: Why don't you report on the DOC/EOPSS CORI violations and Boston Herald, WDHD Defamation against Joanna Marinova?

Hahahaaaa... He didn't really say that, but he did slam the DOC for trying to shield hastily-departed Chief Harold Clarke, more on this momentarily.

Carr may be correct that he broke the story on the Probation Department, but under that same Department -- EOPSS -- Howie Carr hasn't said "Boo!" about the the corruption and CORI leaks at DOC and I know why:

It’s because his paper is the one getting jammed up, and Judge Cratsley’s Order of 22 November 2010 slamming the DOC/EOPSS attempt to shelter hastily-departed Chief Harold Clarke doesn’t really do Jessica Van Sack, the Herald -- or Sunbeam Management/WDHD - Channel 7 any favors, and here’s why:

Even though the DOC cannot restrict Defendant inquiry by subject matter (the Court did restrict the time to one hour), nothing he says will change what we already know as established in the movies linked below:

The DOC is far too tight-lipped to have actually told Jessica Van Sack or Byron Barnett that Joanna Marinova had sex with anybody, and the Darrell Jones disciplinary report (D-ticket) speaks for itself: Darrell Jones was cleared of any sexual misconduct and Ms. Marinova’s name doesn’t even appear on it. And I’ll have to check my files again but I believe the Herald knew that Plaintiff Marinova had signed in to visit Mr. Jones as she is supposed to do, and as she had done on prior occasion.

Therefore it is your employees, and you employees alone, who are responsible for the Defamatory accusations. See y'all at the next Court hearing, wouldn't miss it for the World. Meantime you newbies watch the movies.

And by-the-by, Harold Clarke's dossier is really horrible on open records and abuse, he ran from Washington before a pending vote of No Confidence. Governor Patrick twice publicly stated to me, at his Town Hall meeting and during an impromptu Juneteenth meeting that his administration was going to "conduct a thorough investigation"to "get to the bottom of this" (Town Hall) and that he would "put it to bed" (Juneteenth). So perhaps he did, maybe he made Clarke talk a hike, who knows. From Prison Legal News:

Heck, Howie and the Herald missed a Golden Opportunity to throw another racial slur, as they did when they celebrated the Departure of a Reformist DOC Chief John Boone, "Boone the Coon." I suggested they try "Clarke the Dark." Joanna Marinova v. Boston Herald et al. Defamation case updates: Jessica Van Sack and Byron Barnett are in Big Trouble.

Basically now it appears that the DOC has moved to delimit the upcoming Deposition Testimony of hastily-departed Harold Clarke, but they apparently screwed-up the Rule 9A Notice Requirement so the Court now has filings 27, 28, 29 on the Bench, I visited Judge Cransley’s chambers but he was on the bench and I couldn’t read the DOC’s EMERGENCY Motion, Plaintiff Marinova’s response or Sunbeam’s (Channel 7) Memorandum in Opposition. Whether the DOC gets the restriction originally requested in this document 26 shown here, they still have to deal with the common sense notion set forth by McDonald:

As to Michael Picardi, the mastermind who helped disassemble the gun that allegedly killed Revere Police Officer Dan Talbot, he's up on Accessory charges with regard to a knifing that Derek Lodie did to an unsuspecting mook immediately before the Dan Talbot shooting, under almost identical circumstances. Picardi and At bottom is a video with the same Judge Cransley giving Lodie an Easy Out on some other criminal charges, here is my journal entry on that piece. In tomorrow's case The Deal is that Lodie and Picardi cooked up a story to frame someone other than Lodie, the same way that some say they cooked up a story with respect to the Dan Talbot murder. Lodie got 8-12 on his Accessory charges, not concurrent as I understand, as I noted in this recent Jason Batman Watson journal entry about how this "altruistic" repeat criminal got an Easy Out from Federal District Judge Tauro on his pending weapons charges. Now Batman (who earned this name from his style of assaults) is up on a renewed Restraining Order held by the mother of his child, and is facing charges for attacking his current GF and playing stick-up games with a local Cabbie.

Remember: Officer Soto testified in video I probably have in my archives that the muzzle flash came from the guy in the red hoodie, and that would be Lodie, not Robert Iacoviello. Proffered testimony (watch it on KingCast video) from Michael Racca at trial supports that notion. It is possible, I asked in this journal entry, that DA Dan Conley and the Jury convicted the wrong guy?

It's nigh on impossible to keep track of this stuff, but somebody's gotta' do it.

Remember this post yesterday where I found the 6 Oct. 2006 Entry from Judge Groff denying Summary Judgment and finding that Senator-Elect Kelly Ayotte violated the Rules of Civil Procedure? Well the Court was being quite charitable to Kelly in not mentioning the fact that I had filed a rather damning NAACP First Amendment Legal Brief just prior to dismissal.

His Honor didn't mention the Memorandum in his Order denying Summary Judgment, but you had better believe if Kelly Ayotte thought she had the beans to get me for Unauthorized Practice of Law, she would have gone to trial. And I would have videotaped each and every agonizing moment of Kelly and Attorney Stratton getting their behinds handed to them by Yours Truly. Wherefore, she dismissed the "case" against me.

Along the way, however,I totally busted Senator-Elect Kelly Ayotte for an attempted ex post facto application of New Hampshire Law, specifically then HB 1768 vis a vis Chapter 311. In that post see also my proposed Stipulations, Findings of Fact and Conclusions of Law, I had to do all of that to kick her ass, just to be free from Unconstitutional encroachment from Kelly Ayotte and her crew of Open Government Free Press haters. Conduct like that from Kelly Ayotte against my lawful conduct as an NAACP Officer certainly gives rise to a claim that she is indeed, a bigot. I've already shown you in the video that DOC/EOPSS Public Affairs Director Diane Wiffin never told Jessica Van Sack or Byron Barnett that any sex was involved, so no need to go back over that now but get a load of this 3 June 2009 email from Charles E. McDonald, Mass Sex Offender Registry Board, also under EOPSS:

"The ticket didn't say anything about sexual acts. The officer wrote it was dismissed. This statement needs to be put out because no one is speaking out. The administration should have responded that these allegations are clearly not true.

What we have here is a crooked cop who is not only presenting a lie, but also snuck the information out of the institution which is violating CORI laws and CORI information. If the Herald did their research they would have seen that it was all dismissed. It was the Herald's and Jessica Van Sack's Responsibility as a reporter to look into all the facts. Jessica didn't. She ran the story. So either she got a forged report or she intentionally ran it."

Basically you can see that the Herald Reporter Jessica Van Sack was on a deadline, she made up a story about Plaintiff having sex with a prison reformer inmate named Darrell Jones (with CORI information illegally-obtained from someone at the DOC) and Channel 7's Byron Barnett followed suit and republished it. I helped Plaintiff Marinova curry support and representation from Todd and Weld, one of the strongest First Amendment firms in the Northeast. Further, the Herald has had -- and continues to have -- issues with racism for quite some time, they called a former DOC Superintended "Boone the Coon" and read this case:

While the Washington GOP establishment is reportedly courting Ayotte as the “younger, dynamic female senator” emblematic of their new moderate façade, she's apparently seeking the tea party's seal of approval.

"We only get into races when we are asked,” said FreedomWorks spokesman Adam Brandon, indicating that Ayotte sought out the group's support. Brandon said FreedomWorks made the endorsement only after gaining "consensus from our guys on the ground -- we can’t endorse if our activists’ membership is spilt."

The back story part one and part two, along with KingCast audio from TOUCH 106.1 FM, with Plaintiff above. Part two is a direct response with three (3) different empirical DOC studies that I sent to an anonymous DOC poster who wrote in to the Boston Phoenix, ripped him but GOOD.

The bottom line is that Jessica Van Sack had direct knowledge before she wrote and published the story "Fox in the Hen House," that she was using illegally-obtained information. Why she did it, and why she thought she could get away with it is anyone's guess. That is why the Boston Herald Attorneys at Brown, Rudnick have embarked on a scorched-Earth policy in this litigation, going so far as to issue subpoenas to Plaintiff's mother, even though her Affidavit confirms that she had no knowledge of the events at hand.

The Parties have also filed three (3) subpoena duces tecum to DOC/EOPSS' Information Tzar Terrel Harris, which were denied pending further specificity by Suffolk Superior Judge John C. Cratsley. Plaintiff moved to take the Depositions

of EOPSS' Harris and Public Affairs Director Diane Wiffin and the Court granted this request but limited the scope of inquiry: The Parties may inquire as to what Mr. Harris or Ms. Wiffin or allegedly told WHDH reporter Byron Barnett.

As you can see from the Pleadings in the body of this update, Reporter Barnett is hanging his hat on Diane Wiffin or somebody -- anybody at EOPS allegedly telling him the Ms. Marinova engaged in sexual acts, but the emails from Ms. Wiffin to tend to refute such assertion. I have posted on such email from Ms. Wiffin, written on 14 May 2009 -- before Defendants Herald and Van Sack published the Defamatory allegations that Ms. Marinova had sex with an inmate(s) and that she was not permitted to be a visitor. She was fully permitted to be a visitor regardless of State Representative Fox’s capacity as an investigator.

"Hi Jessica! In addition to CORI (MGL Chapter 6, Section 167-168 is the CORI statute that prohibits the DOC from disseminating information on anything pertaining to an inmates incarceration with the DOC), an immate move is a departmental security issue and we would not talk about it..... Diane."

Now exactly how what part of CORI privacy Reporter Van Sack failed to comprehend, I can't say. I have more from Ms. Wiffin to Defendant Van Sack, wait for the movie tonight.

The Defendants moved to Depose Superintendent Gary Roden, Sergeant David Malone, David Hockey, Co Janet Correia, CO JoEllen Gardner, Superintendent Stephen O'Brien, DOS Nelson Julius, CO Graham Trout and the hastily-departed DOC Director Harold Clarke. DOC/EOPSS filed timely Motions for Protective Orders. In its ORDER of 5 October 2010 the Court ruled as follows:

1. Gary Roden -- Protective Order granted.

2. David Malone and all CO's -- Protective Order denied, Deposition inquiry limited to the events of 28 & 29 Nov. 2008, and 7 May 2009, and the Darrell Jones disciplinary report and hearing noting the dismissal of any inappropriate sexual contact charges.

3. Harold Clarke -- Denied, Deposition to occur before 31 Dec. 2010.

4. Mary Beth Heffernan -- Protective Order granted.

Darrell Jones' Deposition will be scheduled prior to year's end as well, and it should be fascinating. The Defendants and the DOC are about to publicly get their eyes opened to something that they might wish they never inquired about in the first place. I believe that Deposition my friends, is a public record and I will be posting it in its entirety. Well even if it isn't public record, Mr. Jones will give me first dibs and send me a copy anyway, so there you have it.

My how the time flies..... I'm sure that DOC/EOPSS is quite busy with the recent alleged assaults on black prisoners at MCI Norfolk and thehasty, unplanned departure of DOC Chief Harold Clarke and five (5) CO's, but the response to these requests was due on or about 1 October 2010 -- before all of that, as the time-stamp indicates...... so it's time for a trip on down to EOPSS this morning to get things sorted. Again:

Prequel to Terrel Harris: Per MGL 66 § 10.: Please provide access to review any and all documents you provided to Brown, Rudnick in response to their 23 August, 2010 Subpoena Duces Tecum Request within the time alloted by Law. See Attachment 1.

Governor Patrick has his work cut out for him in order to prevent our prison system from being shrouded in secrecy, which he specifically stated he does not want, at the town hall meeting last year, above. In addition to Clarke's rapid departure, there is this bit of fun: While I was not able to attend the First Marinova v. Herald hearing last week, I know that all of the managers, like 5 or more that the Herald subpoenaed are all MIA.... I had ordered the Death Certificate of the head perp months ago, cardiac arrest if I recall correctly -- but what of the others? These people went and got the hell out of Dodge, I'm telling you. This case is deeper than most people realize, and perhaps even deeper than I even thought, and that's DEEP. Click here for your back story.

As to the Clarke resignation, I keep thinking to myself.... What that (hell) is going on here.... As if Deval didn't have enough crap to deal with right now other than this. Successful prison reform activist Darrell Jones is asking the same question, and trying to provide a prescriptive plan but nobody seems to be listening.

How Governor Patrick handles this situation will define his career in many ways. Clarke was his boy, but he had his own questionable policies (read: double-bunking) and the system has considerable indifference to reform in general to say the least. This dossier reveals a mixed bag of treats for Clarke, good on inmate programs but niggardly on public information requests. Says Jones (full document and audio to ministers coming):

"I just got word that you resigned on this Saturday October 9th, 2010. How could you come to Massachusetts, sell us the hope that something will change, then the fight gets thick and one day after the report of a black male being jumped at this Prison (MCI Norfolk) and beaten badly- all the Spanish and Black inmates are walking around here worried about it. I have tried to tame them and keep telling them that something is going to change so they should “hold tight”........

How could you not wait until the Governor election was over to announce that? Why now? Why did you come here and promise reform or is this the only State that can not be reformed? This happened with Boone and Dennehy as they were trying to reform the Prisons and now you leave in the middle of reforming it after everyone spent so much to get you here.......

I was able to get gang-members together to speak out against this violence. I was able to get them on albums and working together, I was able to direct them into a positive space- just check my record. Let’s tell people the truth! I am just one man and there are others who do it, but you are the only one who has the OBLIGATION to do so! And Governor Patrick: Is everyone who was down the ladder now move up?.........

I am calling on the Governor and these Reverends to listen to Kay Khan and get an Oversight Committee before we all die in here because Massachusetts Corrections is being run like a gangster organization."

Reports of the alleged attack are circulating from MCI Norfolk Minority Chairman Darrell Jones. The event was witnessed by many inmates and the situation is tense. Reform is needed. iPhone post, more to follow.
Prisoner Brent Stevenson got jumped (while outside) by CO Charlie and a few other officers and a Sergeant watched it happen since 1pm. The entire facility is riled up as many prisoners saw the attack. The Government must send someone to investigate immediately before this grows into a very serious situation. Some say the sheriff is in a tough spot. Facing a firestorm of criticism over the budget, the normally camera-happy sheriff has gone underground. For a man who spends so much time in the spotlight, critics say the silence is telling.

"The fact that he's not willing to answer the tough questions, dodging interviews... He's the elected sheriff of this county, he should have the doors open," says outspoken Sheriff Joe opponent Dan Saban.

Maricopa County Auditor David Smith clearly stated there is no doubt that monies have been misspent. The money was to be spent on improving the jails, which never happened. Instead it was spent on lavish trips and Immigration sweeps.

He's just like his toady, NH U.S. Senate hopeful Kelly Ayotte, who has flip-flopped on Unconstitutional Immigration policies, as noted by Debbie Schlussel and Yours Truly. She screwed over the New Hampshire budget to the tune of $110M on the Tuttle/JUA cases, affirmed on appeal read it all right here, along with the FRM Ponzi scam she failed to catch as AG, and her coverup of the Franconia shooting tragedy, soon to be a Hollywood movie. BTW, Wisconsin cited the Tuttle/JUA case, in Wisconsin Medical v. Morgan, what a legal legacy for Kelly Ayotte to leave, ahem.

She also lied to the public about "winning" the Planned Parenthood case, when in fact she cut two $150,000.00 checks to Planned Parenthood Attorneys because the NH law was poorly drafted and didn't pass Constitutional muster. I have a copy of the checks right here.

You can determine the integrity of any given candidate for any given position by observing how they embrace -- or disavow -- Open Government principles.

Of the nine (9) men involved in the reform project, only four (4) remain together at Old Colony. Interesting.

Here's the rub:

They are always conducting inquiries and issuing reports (The Harshbarger -- you know him, the former AG -- Report 2004) (Future Search 2009) & (Boston Foundation 2009) a ton of lip service -- some of it well-intentioned, but when somebody does something about it they catch Defamation (Marinova and Jones) or retaliation, like Jones and former Commissioner Kathleen Dennehy, a 30-year veteran. She had a videotape of a cop kicking a prisoner in the face, she fired the guy and the DOC did nothing to support her position and he was resinstated. She stood up to the Union and wrote a letter to Governor Patrick imploring him inter alia, to get truly independent real investigation into abuses like this. Look how far we’ve come!

Addendum on Joanna Marinova's Potential Civil Claims:

Her neighbors are about to write Affidavits that Channel 7 walked up to them, unsolicited, and said they wanted to interview her because she had sex with an inmate. I've seen her paperwork and without getting into that publicly, I am 99% certain she lost valuable career opportunities and opportunities to help the community because of this.

I blogged about Amy Goodman's situation involving the 2008 RNC beat down and 800 arrests in this post. Here is the Truthout 9 May, 2010 feature on the lawsuit, filed by the Center for Constitutional Rights.

I mentioned it at 8:30 of the KingCast movie (above) showcasing several forms of viewpoint and content-based abuse leveled at me during the GOP Joe Arpaio love fest in Nashua, NH one week ago to the Day. Now let's see if GOP Secretary and Committee Chair Karen Thoman grants my requested apology for whacking my camera with her GOP flyer at an even that most certainly was NOT private, as anyone could buy a ticket and other media were there.

Anyway, King's video is entertaining mainly because of what happens to him: A GOP hausfrau whacks his camera with a pamphlet; some Republican crone orders him out of the building; and the local cops force him to amscray under threat of arrest, even though he's credentialed and there are plenty of other media types there. The video's a tad long at 12 minutes-plus, but worth every second.

Not to mention the fact that Kelly Ayotte threatened to arrest me 2 weeks prior at a public event advertised on Facebook no less, watch the video.

And I am talking about moving for Injunctive relief with some well-respected local First Amendment Counsel as well. And the compelling thing is, I need immediate relief because the fall elections -- in particular the U.S. Senate 2010 race -- loom large. In contrast, the relief sought against the RNC is temporally stale by comparison, though no less significant of course.

These requests are heavy and they concern fingerprint analysis, gunshot residue analysis and information how How Gregory Floyd may have unloaded the first clip and loaded the second clip of Liko Kenney's Hi-Point to make him appear more dangerous AFTER he shot, and likely murdered him. That's pretty much the only way you go home with one of Liko's live rounds in your shirt pocket, which is exactly what Floyd did. And that's a FACT.

After he shot out Liko Kenney's winshield and lied about it, of course. I proved all of that with the official court documents hosted at the Casey Sherman "Bad Blood: Freedom and Death in the White Mountain" book launch. As you and I (and Alderman Teeboom and your Republican peers Jennifer Horn, Sandra Ziehm and City Attorney Bennett) agreed 3 years ago that government should be open and accountable when I threatened to sue the Nashua School Board over Julia Earl's restrictive speech policy, our conversation should be out in the open as well.
In fact, you said:

"Those are mighty big words for someone who's not on the policy committee.....I've reviewed the matter and I think that Mr. King ends up being right.... I would not rush out to test Mr. Cleamons just yet."

Last night I told you that I am narrowing my issues for Police Chief Conley regarding the Assault/Disorderly Conduct/Harassment I received from Karen, who reached out and struck my camera in a most unprofessional manner. And I told you that she did it with a smile on her face and with glee, standing right next to a white police officer who didn't even say anything to her, but who did then admonish me not to hit or to strike anybody. Now my complaint against that bigot is a separate issue but for now let's stick to the simple fact:

You don't offensively touch anybody else or their possessions much less a relatively expensive camera, without their permission.

That's pretty simple isn't it? It is a tort. It is certainly more simple than the School Board issue. So as I say, I'll be traveling for the next week but when I discuss this with you next Wednesday I would hope to have this matter resolved with a simple apology because I don't give a damn what kind of absurd excuses my Internet troll haters raise up, I was on my zoom lens and well more than an arm's length away from her, she reached out and struck my camera, and you can see it in slow motion for Pete's sake.

Watch the woman apologize to me for calling me a bigot at Kelly Ayotte's other rally where she also threatened to have me arrested despite an open Facebook invitation. The two of us then had a nice and informative talk, same with the bloke to her left, a Dartmouth professor and tennis player. That's how I am, OPEN. But I won't take any bullshit, never have and never will. I am a member of the media, and I don't cease to be a journalist just because I left a daily to go to law school.

Wherefore, without an apology, I see that New Hampshire (and the GOP) really is a backwards, racist, white skin privilege State as suggested here. Please read Peggy McIntosh's "White Privilege: Unpacking the Invisible Knapsack."

1. The New Hampshire Supreme Court allowed a Bad Cop named Martin J. Dunn, and his establishment lawyer Dan Mullen (former Kelly Ayotte waterboy) to repeatedly lie about me to the Court and get away with it. Specifically , they lied and said I was "disbarred," they lied and said that I "misrepresented [myself] as being licensed in New Hampshire," they lied and said I wrote a "Fraudulent letter" from the NAACP (see NAACP Veteran's Chair Cleaven Ferguson's Affidavit) and they lied about me saying that Dunn raped his daughter. In reality it was Meshugana Marty laughing at a racist hate mail to me that said

"You better save your food stamps you goin' need protection where you're going, you bout to be Bubba's bitch."

All of these matters invoke Rule 3.3 Candor to the Tribunal concerns, and they besmirch the Court and legal community, but as two duly licensed area attorneys (and I mean partners in well-respected law firms) noted to me "King, don't you know you're messing with good white people, and you are a black man in New Hamsphire without the kind of power or money to do that. They hate you." And that's purely evident that they do not care about Justice, Truth or Accuracy.

2. The GOP attacked me at the Jeff Arpaio rally and there is no question but that if I had struck one of their cameras the same way that I was struck, I would have been arrested, pronto, never mind that Mayor Streeter gave me a Mayoral Commendation for all of my diligent First Amendment work. The cop stood right there and criticized me instead of admonishing this white woman who lost her cool and broke the law, smiling with glee the whole time, the video doesn't lie, folks. I telephoned Police Chief Conley this morning and he never returned my call, so I will go see him in person tomorrow and file my complaint.

Well guys I hate to do this, and I fully recognize that each of you believe that you have your own distinct merits in the U.S. 2010 Senate race. The problem is, if you don't combine your votes, Kelly Ayotte is likely to win. I support Ovide because he actually went to Franconia, the home of Kelly Ayotte's biggest coverup (that we know of at least, let's wait for Casey Sherman's "Bad Blood: Freedom and Death in the White Mountains" movie) and out of the three of you he is pretty much the recognized front runner at this point.

As any of you would bring more integrity to the office than Kelly Ayotte (as seen yesterday at the GOP rally), you should make certain that one of you gets in. Then you can always work together on initiatives on which you agree. A bird in the hand is worth two in the bush.

Oh it all went away, but it goes to show what a hater she is. Last week Landrigan affirmed what I've been saying for a while about how she lost the Planned Parenthood case.

Now the Michael Holman case is getting interesting as well. Kelly Ayotte's office received dozens of pages of information about Unconstitutional practices against him by Madison Chief John Pickering that have allowed his children to remain in the care and custody of a negligent mother while issuing bogus threats of arrest and trumped-up charges against him. Even the Boston FBI is aware of a substantial file that they obtained from the NH AG in 2009, as noted in its initial review, which has since been revisited. Congressman Jay Inslee and others are looking into that matter, meanwhile read his position statement and FOIA/RSA 91-A Right to Know correspondence (referencing 19 pages of now-missing documents) indicating that the NH AG's office -- under Kelly Ayotte -- destroyed his entire file except one page.

Congressman Inslee's 15 October 2007 letter acknowledged a huge packet of information, much of which should have been on file with the NH AG's office.

Supporting Unconstitutional practices is nothing new for Kelly Ayotte, remember her run at me as NAACP Legal Chair, her support for Unconstitutional DNA reporting for NH youth and her deceitful misrepresentations in losing the Planned Parenthood case, while claiming that she won? Kelly Ayotte real legacy is well documented right here.

Maybe that's why TPM shows Ayotte in trouble, and even the conservative Union Leader -- which itself has been a potboiler for political corruption in the past, recall Ed Muskie and the Canuck letter -- endorsed Ovide Lamontagne in the Republican 2010 U.S. Senate race.

The case of Darrell Jones illustrates how petty and vindictive the relationship between guards and inmates can be.
In May of that year, Jones charged, in an audio clip posted online, that officer harassment of inmates had reached its "highest level ever," and complained, "They're tearing down anything we try to do that's positive." The day after his tirade went public, Jones was placed in segregation.

Six days later, Jones' appeal for outside help appeared to have been answered: he received a visit from State Rep. Gloria Fox. Accompanied by Jones's girlfriend and collaborator Joanna Marinova, Fox had come to discuss claims of officer misconduct leveled by AHC members. The day after that meeting, Jones was relocated to MCI-Norfolk.

A civil action will examine whether OCCC officers manipulated the media to retaliate against Jones. In May 2009, the Boston Herald ran a page-one story titled "Fox in the Big House," in which reporter Jessica Van Sack wrote: "State Rep. Gloria L. Fox is under scrutiny for allegedly sneaking a murderer's girlfriend — previously bagged for engaging in 'sexual acts' with the killer con — into [OCCC]." Citing two confidential sources, the article claimed that Fox, the state rep from Roxbury, used her legislative privilege to bypass security checkpoints for the purpose of escorting Marinova into restricted areas where she could see Jones. In the month that followed, the Herald trumpeted the story despite proof in disciplinary reports that charges of "sexual acts" between Jones and Marinova had in fact been dismissed by OCCC supervisors. Marinova is suing the Herald and WHDH-TV7 over the story, claiming the outlets based their reports on false information that was maliciously leaked by OCCC employees.

“I, for one, am tired of seeing the same old scenario played out each year, i.e., dead youth, press conferences and a political and spiritual tug of war between the same people who should be uniting to bring change to Boston. Before I ask to speak to the city over my radio and television network (Boston Praise Radio), I am asking you to hear my reason for calling for the comprehensive plan to study the root cause of homicides in our city.

Please know that I will not simply go away. I am not and have never initiated any campaign to embarrass you or your administration.

You could become the hero mayor of our city and any urban city if you care enough about the families in Boston to go along with the idea to study Boston's youth violence problem.”

2. Boston Phoenix – Look this week for their review and investigation into the Draconian measures at Old Colony. Turns out that Darrell Jones and Joanna Marinova were not the only victims of the sexual misconduct write ups. Remember, the dirtbag “journalists” chez Boston Herald and Channel 7 WDHD turned that into “had sex with inmates….” All of which was FALSE and resulted in a massive pending lawsuit, and DOC/EOPSS IT/Communications Director Terrel Harr tells me there are subpoenas issued to his office, probably from the Defendants, who are about to get their fannies handed to them when they get the responses and schedule Depos.

3. PressPass TV, KingCast – Watch the video with wrongly-convicted prison reformer Darrell Jones, who has personal correspondence with Senator John Kerry on these matters. He told me so, and I have zero reason to doubt him. We can address these issues with much greater alacrity if Mayor Menino and Attorney General Coakley come together and get serious. But AG Coakley’s office is deep into double speak, read her letter to me in response to my public information request last week, so insane I had to file another request immediately as seen in the link in the next paragraph.

Query: Whose interests does the AG represent? Is she tacitly defending the actions of the DOC staff (the DOC is not a named Defendant) or is she going after the corruption and the CORI leak. From her nonsensical response to my inquiry we can’t really tell, but my follow up inquiry will clear up all of that there obfuscation. Read all about it here.

Yet, as attorney general in April 2009, Ayotte approved spending $300,000 in taxpayer money to settle the case and pay the legal costs of the opposing party, after a U.S. Circuit Court of Appeals judge decided Planned Parenthood of Northern New England was the winner.

My comment to him follows:

Right on Kevin, we need large scale reporters like you to tell the Truth, I have been noting that for a while now about Kelly on the Planned Parenthood case. I....... love it. Serena has a fantastic broadcast voice, and the shared fact that both families have World Class tennis players on board provides a natural backdrop and basis of understanding. Serena said she wants to be the best tennis player to make a difference and to help people. I can dig it, I love helping the Youth, Dagha and I did it in Mattapan and at the NYSE this spring in the NYSE/America SCORES Poetry SLAM! Look for this alliance to continue in the coming years as the Williams sisters slow down. The McEnroe brothers are wedded to tennis and a bunch of Good Things as well. We as tennis viewers should encourage this type of thing, especially given all the B.S. hype people spewed out about Mac being a Williams hater, blah blah blah all BS there is mad respect all around there. Here's your back story. Michael Picardi's lawyer, Charles F. Jordan, is a pretty interesting guy. Anyway they filed a Motion to Dismiss and he ordered his client not to come out, so I'll have to wait for the Trial or the Plea. Meantime we shot the shit about baseball, it was a very compelling discussion I'll say that, but that is strictly for those of us who were there to know :)

It is a very interesting case, legally, as it involves 274/4 Accessory After the Fact and 268/13B/A Witness Intimidation. The actus reus is different for each crime, I will explain later when the Court rules on his Motion but some of it of course deals with his little Conspiracy to Lie with Mr. Slap-on-the-wrist Derek Lodie. In fact, Lodie got such a walkover for fabricating evidence, stabbing someone and lying about it that would be logical to question whether he has something on somebody, like if the Revere PD had jacked him up for an 8Ball or something the night Dan Talbot died but agreed to keep quiet about it while he fingered Robert Iacoviello. Given the sheer amount of BS in the Dan Talbot murder trial , including magic casings that land on Gatorade bottles, one has to ask.

I seem to have dropped the audio here but not to worry, I'll be there for the next hearing and the trial or Plea Agreement, and so will Mr. Picardi at that point. But what about the lack of toxicology tests and results, I'm going to ask my First Amendment Foe DA Dan Conley for that, remember I was on this back in February, 2008 and that's one reason that dude can't stand me. So be it, I'm gonna say what I wanna say, and ask what I wanna ask, this is America, dammit.

WHEREFORE, DA Dan Conley: Please provide a copy of any and all full toxicology reports for each and every Revere Police Officer who was present at the Revere High School at any point during the evening that Dan Talbot died, per MGL 66 § 10.

If you have no responsive documents, provide a copy of the documents evincing your attempts to gather such information from anyone.

Soooooo......I just received a nonsensical letter from Mass AG Martha Coakley’s office in response to my request for any and all documents evincing any investigation into an unauthorized CORI leak, relative to Marinova v. Boston Herald, Jessica Van Sack and Channel 7. A fun video of my follow-up visit, a copy of the letter itself:

“There are no documents responsive to your request…. (also) It appears from the evidence you provided to us, your complaint does not constitute a CORI violation."

Here's the underlying CORI/Defamation case where the Herald and Channel 7 said Joanna Marinova had sex with an inmate in discussion on Beat the Press. The information leaked about Darrell Jones is clearly not of a public nature, much less does it indicate that he and Ms. Marinova had sex while they were working on Prison reform with State Rep. Gloria Fox, for Crissakes...... And here is Joanna Marinova at the Mattapan Public Library screening her award-winning PressPass TV videos, "Voices Behind the Wall" and "Mr. President," made in conjunction with noted prison reformer and wrongly-convicted inmate Darrell Jones. Video at bottom.

First off, it's not my complaint that I'm alleging was a CORI violation. If Attorney Tarrow means to say that the underlying subject matter of my complaint was not a CORI violation, that's another thing.

Second, The problem is, she would be wrong there, very wrong per Globe v. District Attorney for the Middle District, 439 Mass. 374 (2003). The Holding reads in pertinent part:

"We therefore conclude that the wording of the declaratory judgment must be modified to limit it to those record requests that are framed entirely in terms of information that would be available from court or other public records, as only those requests call for disclosures that are entirely exempt from the CORI statute. The case is remanded to the Superior Court for modification. The declaration should be amended to read as follows: "Docket numbers of criminal cases prosecuted in public judicial proceedings, correlated with information that is also available from court or other public records, but not correlated with defendant-specific information, are public records under G. L. c. 4, s. 7, Twenty- sixth, subject to mandatory disclosure under G. L. c. 66, s. 10, and their disclosure is not prohibited by the CORI statute, G. L. c. 6, s.s. 167 et seq."

Her boss, Deval Patrick, twice publicly stated to me, at his Town Hall meeting and during an impromptu Juneteenth meeting that his administration was going to "conduct a thorough investigation" to "get to the bottom of this" (Town Hall) and that he would "put it to bed" (Juneteenth).

Attorney Coakley, obviously he disagrees with you, but if the investigation is closed please produce a copy of any and all documents you have in your possession. If you produce nothing I will assume the investigation

a) is open, proving you wrong, ipso facto.
b) never occurred.

And Coakley ran for Senate, losing a seat that was all but handed to her while Kelly looks a bit stronger in her race, mostly because she keeps the Truth about her background from the General Public, even resorting to threatening Yours Truly with arrest for asking a few simple questions about Boston writer Casey Sherman’s book and upcoming movie “Bad Blood: Freedom and Death in the White Mountains” at a public event. Where was she on the Cat Gibbons case, where her Division of Banks erroneously and selectively targeted one of the State’s only black female mortgage brokers for doing Stated Income Deals, even though none of her Deals resulted in foreclosure and she put no one in Harm’s Way. Good Thing that KingCast cameras came out, and the KingCast network of attorneys got involved and Ms. Gibbons will be able to apply for her Loan Originator’s License immediately, and her Broker’s license in a few months, rather than the permanent revocation that the DOB explicitly stated it was seekin on the record -- and in KingCast video.

C) Further provide documents that show how these monies were applied to the State Budget, and what departments and agencies received funds from these fines.
D) And while you're at it, please provide an accounting of all monies derived from motorcycle registrations by Massachusetts General Law (MGL) Chapter 90 Section 34 for each of the calendar years 2000 through 2010, inclusive to date. As you are a skilled and professional attorney I'm certain you will have advised your boss and client, Governor Patrick, to take care of this.

There's Danny-Boy with another lying client of his who likes to threaten me with arrest (watch the video) one Kelly Ayotte, on their way to costing NH Taxpayers god-knows-how-much in Attorney Fees assessed against Kelly by the Federal Court.... Well I will know soon, here's my RSA 91-A request to NH AG Michael Delaney. And oh yah, the Bar Complaint is drafted and being posted to WePapers. The legal filings are in this post.

The relevant passage from the Transcript in which Dunn said “That’s a funny letter you’re asking me to read” after I said “Let the record reflect the Deponent is laughing” is attached in the Pleadings, and Dunn and Mullen both knew it because they read my KingCast.net blog “Chris King’s 1st Amendment Page” and even cited to it in the High Court Pleadings, thinking they would never hear from me again. They did not realize I have friends in High Court Places. Again, when it came time to approach the High Court for Certiorari he juiced up his pleadings to make his client look more vulnerable, and that is odious, contemptible and sanctionable conduct.

WHEREFORE I can find no reason why Daniel J. Mullen should not be disbarred for this willful sort of conduct, or at a minimum receive a substantial suspension and fine.
If this Court does not punish this sort of activity it sends a Green Light to large, powerful Defense Firms that they can say and do anything to represent abusive Law Enforcement in New Hamsphire, and get away clean. As a former Assistant Attorney General -- as was Mullen, see picture at Attachment 3 – I would find that to be an untenable position, to say the least.

“Bad Blood: Freedom and Death in the White Mountains” is a book and pending screenplay by Boston area writer Casey Sherman, whose Aunt was the last Boston Strangler victim. Sherman basically proved that the guy they fingered and convicted DiSalvo, IIRC didn’t do it.

Flash forward to this case, in which Kelly Ayotte closed an investigation in 24 HOURS into the possible murder of a young man who shot a bully cop. He was such a bad cop that the town and NH Legislature refused to name any section of a roadway after him, an unheralded move in the SB 154 hearings.

As a former Assistant Attorney General myself I am not anti-cop nor is former Franconia and Sugar Hill LE Bradford Whipple, who appears in the video, but he told the town to fire Bruce McKay 5 years before the tragedy happened. 1. Failed to help blacks feel comfortable in Jaffrey, NH, according to a local business owner.
2. Laughed a hate mail that accused me of being a "coconut head racist... you're about to be bubba's bitch... better get dat vasoline ready." That was during Kelly Ayotte's failed attempt to prosecute me for Unauthorized Practice of Law, just after her idiot LE friend Martin Dunn nol-prossed a bogus case of Attempted Felony Extortion against me after I exposed police abuse under his watch.

It's all here in the seminal Martin Dunn/Kelly Ayotte post, which contains links to last week's NH Supreme Court Pleadings. Seems Dunn and his crooked lawyer Dan Mullen lied about me and several other things that the Court is reviewing now, having corrected some of the lies in an online opinion. Mullen, by they way, was Kelly's waterboy during the failed Planned Parenthood case where Attorney fees were assessed against her.
